By accessing and using FromYonder ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

FromYonder provides online memorial pages where users can create, share, and preserve memories of their loved ones. The Service allows users to:

• Create memorial pages with photos, biographies, and tributes
• Share memorial pages with family and friends
• Connect related memorials through family relationships
• Access memorial pages created through our partner funeral homes

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. Content Ownership and Responsibility

You retain all rights to the content you upload to FromYonder, including photos, text, and other materials. By uploading content, you:

• Grant FromYonder a license to display, store, and transmit your content as necessary to provide the Service
• Confirm you have the right to upload and share the content
• Take responsibility for ensuring content does not violate any laws or third-party rights
• Agree that content must be respectful and appropriate for a memorial service

5. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that is defamatory, obscene, abusive, or offensive
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated means to access the Service without our permission

6. Payment and Refunds

Memorial pages require a one-time payment for lifetime access. All payments are processed securely through Stripe. Please review our refund policy:

• Regular price: $299.00 per memorial
• Partner price: $249.00 per memorial (when referred by a partner funeral home)
• Refunds may be requested within 30 days of purchase
• Refunds are not available once a memorial page is published and active
• Contact support for refund requests

7. Memorial Page Deactivation

You may deactivate your memorial page at any time. Deactivated pages remain in our system but are not publicly accessible. You may reactivate them at any time. To permanently delete a memorial, please contact our support team.

8. Partner Funeral Homes

FromYonder partners with funeral homes to provide memorial services. When you create a memorial through a partner link:

• You receive a discounted price ($249 instead of $299)
• The partner funeral home receives a commission for the referral
• Your memorial page will display the partner's branding
• The partner does not have editing access to your memorial unless explicitly granted

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Intellectual Property

The Service, including its original content, features, and functionality, is owned by FromYonder and is protected by international copyright, trademark, and other intellectual property laws.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. FromYonder shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

12. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
